General Use Of The Site

Welcome to www.robbiewilliamstickets.com (the "Site"). The Site is operated by Trinity St, The Queensway, Leamington Spa, CV31 3JT (“Trinity St”). The Site is owned by The In Good Company Co Ltd, 1 Little New Street, London EC4A 3TR IGC REG NO 4389178 ("we," "us") on behalf of Robbie Williams. By placing an order for tickets you accept all of the following provisions below, which govern your use of the Site (“the Terms”). Once your order is confirmed, your contract for the purchase of tickets made through this Site is with The In Good Company Co Ltd.

You must be at least 16 years of age to browse the Site. If you are under 16 you may only do so with the consent or involvement of a parent or guardian. If you are a parent or guardian of someone under the age of 16 who is using the Site, you agree to these Terms and our privacy policy as set out further below and that you shall be responsible for the conduct and acts and/or omissions of your children in using the Site as if these were your own. We will not sell tickets to anyone under the age of 18.

2. General Representations and Warranties

You hereby represent and warrant: (i) you have the full power and authority to enter into and perform under these Terms, (ii) you will comply with all applicable laws and regulations in using the Site and in engaging in all other activities arising from, relating to or connected with these Terms.

CONDUCT AND USE OF THE SITE

3. General use of the Site

3.1 You may not use any automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or its content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or its content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site.

3.2 You may not attempt to gain unauthorised access to any portion or feature of the Site, or any other systems or networks connected to the Site, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means. You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site.

3.3 You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of ours, including any account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.

3.4 You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.

4. COPYRIGHT AND COPYRIGHT PROTECTION

4.1 This Site and the underlying computer code used by us to design, operate and maintain the Site and all content and material contained within or available on the Site is protected by rights of copyright, trademarks, service marks, patents, database rights, domain name rights, trade secrets and/or other proprietary intellectual property rights and laws throughout the world. Unless expressly authorised by us, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from materials or content available on the Site. Notwithstanding the above, you may use the content and materials on the Site in the course of your normal, personal, non-commercial use of the Site.

5. WARRANTIES AND LIMITATION OF LIABILITY

5.1 YOUR USE OF THE SITE AND PURCHASE OF TICKETS FROM THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE NATIONAL AND INTERNATIONAL LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

5.2 We do not warrant or represent that: (i) the Site will meet your requirements, (ii) access to the Site will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Site will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations, or that (v) any errors in any data or software will be corrected.

5.3 You expressly understand and agree that we shall not be liable for, and to the fullest extent permissible by applicable national and international law we hereby exclude or limit our liability in respect of, any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Site; (ii) unauthorised access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the Site; or (iv) any other matter relating to the Site.

5.4 Notwithstanding the provisions of this Clause 5, to the extent that we are held by a court of competent jurisdiction to be liable to you for any loss sustained by you as a result of your use of this site, that liability in respect of all other losses shall be limited to the invoiced value of the relevant order you have made through the Site.

5.4 We are not responsible for any third-party links, services, resources or information provided on or made available through the Site. Accordingly, we make no warranties and accept no liability (to the fullest extent permissible by law) regarding such third-party links, services, resources or information, including without limitation, warranties of fitness for a particular purpose, merchantability or non-infringement and will not be liable for your use of or reliance on such third-party services, resources or information.

6. GENERAL LEGAL PROVISIONS

6.1 It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. If we become aware that you have obtained tickets fraudulently or in breach of these Terms, we will be entitled to cancel your ticket without refund.

6.2 We may amend these Terms from time to time, and place the new version on the Site. When we do so, we will place a notice advising that the Terms have been changed on our homepage. Your use of the Site from the date that the amended terms are placed on the Site onwards will be governed by those new terms.

6.3 The provisions in these Terms that relate directly to the purchase, ordering, supply and delivery of tickets from the Site (as set out below) shall apply when we accept your order by confirming by email that we have received payment in full for all the tickets you have ordered.

6.4 These Terms shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between us and you relating to your purchase. We advise that you print off and keep safe a copy of these terms and conditions once your order has been accepted by us. You are further advised to read (and are responsible for reading) all information on this website fully.

6.5 If any provision(s) of these Terms are held to be invalid or unenforceable, it/they will be struck out and the other terms remain.

6.6 These Terms are subject to the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction.

TICKET SALES PURCHASE POLICY

We operate and are responsible for the advanced sales of tickets to Inner Sanctum Subscribers for the Robbie Williams Tour Dates (“Events”) through the Site. Your purchase of tickets via the Site will be governed by this purchase policy and the Terms.

We sell tickets on behalf of third party promoters, vendors, venues or other parties (“Partners”) which means that we do not set the ticket prices or determine seating locations. Policies set out by these Partners may prohibit us from issuing exchanges or refunds after a purchase has been made or from issuing replacements for lost, stolen, damaged or destroyed tickets. When you receive your tickets, please keep them in a safe place. Tickets purchased through the Site will be subject to a per ticket booking charge and a non-refundable per order postage charge. Below for your information’s sake only is a list of these Partners; please note that we reserve the right to change or update this list at any time.

7.    All products and services are subject to availability. Every effort is taken to ensure that ticket information, text and images accurately portray the Event concerned. Slight variations may occur.

8.    We reserve the right to refuse to trade with individuals, whose credentials cannot be verified or where fraudulent use of credit/debit cards is suspected as determined by us, our management, employees or agents acting on our behalf. We also reserve the right to refuse to transact with any country or countries where fraudulent use of credit/debit cards is considered by us or our advisors, management, employees or agents as an excessive risk. We will use discretion in these matters and the resultant decision will be final.

9.    On successful confirmation of order, the contract of sale is made between you and us and shall be deemed to incorporate this purchase policy and the Terms. Confirmed orders will be acknowledged by us sending you an order confirmation e-mail.

10. Tickets for events are issued by us on behalf of the Partners who are supplying the respective Event. Any VAT (Value Added Tax) applicable on the sale of the tickets is the responsibility of the Partner. Accordingly, tickets will be supplied at the price prevailing at the time of the order. Prices for tickets include VAT (Value Added Tax) at the rate in effect at the time of the order. We reserve the right to modify the prices from time to time.

11. Payment processing is performed via Secure Socket Layer (SSL) secure connections between our servers and the banking institutions of Direct Pay Limited and WorldPay Limited, (part of the Royal Bank of Scotland Group). The use of (SSL) is a protocol used on the Internet to encrypt data to ensure secure transmission. This functionality is denoted by a padlock symbol at the bottom of your browser. All payment information is transferred via an SSL connection.

Please ensure all card details and personal details that are required to process your order and payment are entered correctly on the order form as incorrect data will result in the credit/debit card being rejected for payment and can cause delays to the order fulfilment process. We will not be liable to you whatsoever for your inability to receive tickets where this can be shown to be the direct result of you providing incorrect data on the order form.

14. If we become aware that you have obtained tickets fraudulently or in breach of this purchase policy or the Terms we shall be entitled to cancel your tickets without payment of any refund.

15. Payment is charged to the credit/debit card on confirmation of successful payment.

16. Orders for tickets can only be made in the name and address of the card holder; please ensure that the invoice/billing address is the same as the card holders.

17. We reserve the right to request additional identification or make any other reasonable request in respect of credit/debit card or address verification if deemed appropriate.

18. You must accept your order for tickets on delivery. Delivery is deemed to take place when the confirmation e-mail is sent whereupon the risks of loss or damage shall pass to you.

19. Tickets will be dispatched in 2006, approximately 4 weeks prior to the Event that you have purchased tickets for, and will continue to be dispatched up to 7 days prior to the Event to the address of the card holder in the order form. If you have not received your tickets within [7 days] prior to the Event please contact us via http://support.robbiewilliamstickets.com

20. All ticketing enquiries must be made via http://support.robbiewilliamstickets.com. Please note that this support form is for booking enquiries only; event enquiries and information are not available from this address; any event information can be found at www.robbiewilliams.com.

21. Order confirmation and/or tickets that have been lost, stolen, destroyed or invalidated will only be replaced by us in exceptional circumstances and at our sole discretion. Otherwise lost, stolen, destroyed or invalidated order confirmations or tickets will not be reissued and will be deemed to be void by us.

22. Occasionally, Events are cancelled or postponed by the Partner for a variety of reasons. Tickets cannot be exchanged or refunded after purchase unless the Event is cancelled. The following sets out how you can obtain a refund or replacement tickets in these circumstances:

(i)  If an Event is cancelled, moved or rescheduled the Partner may set limitations on refunds or refund you for the price of the tickets directly themselves. If so, we will use reasonable endeavours to notify ticket holders of the cancellation once we have received the relevant authorisation from the Partner.

(ii) If an Event is cancelled, moved or rescheduled and we are responsible for issuing refunds then ticket holders will be offered seats at any rescheduled performance (subject to availability) up to the face value of the tickets or, if the ticket holder is unable to attend the rescheduled performance or the performance is not rescheduled, a full refund. Full refunds for tickets purchased prior to the date of the original event will be given up to the face value of the tickets purchased plus the relevant per ticket booking fee. In order to claim your refund, please apply in writing to Trinity St, Robbie Williams Tickets The Queensway, Leamington Spa, CV31 SJT enclosing your unused tickets within 28 days from the date of the cancelled performance. This does not affect your statutory rights.

23. It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. We do not guarantee that ticket holders will be informed of such cancellation before the date of the event.

24. Other than as set out in Clauses 21 and 22 above (or as otherwise set out in this purchase policy or Terms), no refunds or replacements will be available for tickets bought for Events through the Site other than in exceptional circumstances and at our sole discretion).

25. Tickets remain the property of us, and are personal revocable licenses which may be withdrawn and admission refused at any time upon refunding the printed purchase price. You represent and warrant that the ticket is purchased for personal use only, and that it is not purchased as part of any form of business or commercial activity (save as expressly authorised by the Partner), and in particular, that the ticket may not be resold or offered for resale by anyone whether at a premium or otherwise and may not be used for advertising, promotion (including contests and sweepstakes) or for any other trade purposes. Resale or attempted resale at a price higher than that printed herein is grounds for seizure or cancellation without refund or other compensation.

26. It is your responsibility to check your tickets; mistakes cannot always be rectified.

27. Tickets are sold subject to the Partner’s own terms and conditions, regulations and health and safety policies. You should ensure that you are fully aware of these terms and/or policies as they will govern your attendance at a venue hosting an Event.

28. The Partner may reserve the right to alter or vary the programme due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets.

29. Partners may enforce these Terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the Act). Except as provided above, these Terms do not create any right enforceable by any person who is not a party to them under the Act, but does not affect any right or remedy that a third party has which exists or is available apart from that Act.

30. We make every effort to ensure that all prices and descriptions quoted on the Site are correct and accurate. However, the nature and speed of e-commerce data transfer and transaction processing makes it inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, we will be entitled to rescind the contract, not with standing that we have already accepted your order, and our liability in that event will be limited to the return of any money you have paid in respect of that order. A 'manifest error' shall mean, in relation to an incorrect price, a price quoted in error by us which is more than 10% less than the price that would have been quoted had the mistake not been made.

Please note that in this privacy policy, “we” or “us” refers to The In Good Company Co Ltd who own www.robbiewilliamstickets.com (“the Site”) on behalf of Robbie Williams. The Site is operated for us by Trinity St, The Queensway, Leamington Spa, CV31 3JT (“Trinity St”) who will collect data on our behalf.

 

2.    We are registered as a data controller in accordance with United Kingdom Data Protection Act 1998, under which we are responsible for ensuring that personal data submitted by you is collected, retained and processed in accordance with the Data Protection Act 1998. This Privacy Policy has therefore been prepared to tell you about the way we collect information from you and what we do with that information. This Privacy Policy applies to you whether you use the Site or where you have entered into a contract with us for the provision of tickets.

3.    We will not collect any personal information about you unless you agree to collection and use of your personal data.

4.    When you enter into a contract with us for tickets you will be asked to submit personal information about yourself in order to receive tickets (such as, for example, your name, address, telephone number, email address and financial information necessary to conclude the contract and send you your tickets). We will only collect information that is necessary for us to provide you with tickets that you have requested.

5.    We will hold your personal information securely and will only keep it for as long as is reasonably necessary to complete your order, dispatch your tickets and for a reasonable period of time after the Event for which you have purchased tickets has taken place. We take the security of the Site and the information you provide very seriously and we will take all appropriate technical measures using recognised security procedures and tools in accordance with good industry practice to protect your personal information. This Site has security measures in place to protect the loss, misuse and alteration of the information under our control. We use 256 bit industry standard Secure Server Software (SSL) for your transactions with us. It encrypts all of your payment details including your credit card number, so that it cannot be read as the information travels over the Internet

6.    Whilst we use all reasonable endeavours to protect your security in the manner described above, we consider that it is only appropriate to advise users that data transmission over the Internet and the World Wide Web cannot always be guaranteed as 100% secure, and therefore that you use the Site at your own risk.

7.    We will share the information we collect with Trinity St who are responsible for processing your ticket order and dispatching your tickets to you. We will also share your information with Direct Pay Ltd who are responsible for authorising payment and billing you for your tickets. When ordering tickets through the Site you consent to us providing your financial or personal information to WorldPay. Other than this we will not share your information with any other third parties.

8.    You should be aware that we may release your personal information or financial information when we believe it is necessary to comply with laws or regulations, to assist law enforcement, to enforce the terms under which you transacted with us, or to protect the rights, property or safety of us, users of the Site or others.

9.    Your Internet browser has a feature called "cookies" which store small amounts of data on your computer about your visit to the Site.  You do not need to have cookies turned on to visit most of the Site. A cookie will not provide us with any personal information. Therefore, if you have not supplied us with any personal information, you can still browse our Site anonymously.  We do not automatically capture or store personal data from browsers to the Site, other than to log your IP address and session information such as the duration of the visit to our Site and the nature of the browser used. This information is used only for administration of the Site system and in the compilation of statistics used by us alone.
